When I adopt Daxter from Ratbone there are these paragraph on the contract that says as follow:
• to return this dog to Ratbone Rescues if custody is desired to be relinquished for any reason.
• that under NO circumstances may this dog be sold or given away, either to a relative, a stranger, another rescue organization, or an animal shelter.

I am thinking to make a will just in case something happened to me and in the event that I pass away (not that I am going to soon but you never know) I just wants to make sure that my dog will be taken care of.

So in this case based on the contract that I sign, is this means that I have to make a will stating that Daxter should be returned back to Ratbone and I cannot have a say who should have my dog and take care of him. Or can I say on my will that Daxter should be returned to Ratbone first and then Ratbone will evaluate the person that I think will be a best match to take care of him?
What do you guys think? And how do you make this will, do you just go to a family lawyer to do that and will the state of California honor my will since this is a will about a dog?

What do you guys think? Anybody has ever make a will for their dog? Thanks!

Well, first the wouldn't be just about yuor dog. You'd make our your will and include what shoulld happen to Daxter in the event..... Not sure about California, but I'm sure you can get info on line or at your public library about doing a living will. Not sure what Ratbone's policy is on what should happen to your dog should the adopter pass away. I'm sure this is something you could find out about if you contact a lawyer.

Monica, Beleive it or not you can get a "generic" will from Office Max, fill it out and have it notarized and it will hold up in a court should you need it too. I worked in trust for a long time and I know it's at least that way in Ohio. I am not sure but I got Fred from Russell Rescue and they have the same lingo however should something happen to me he is going to my mom.  Hope that helps!

Thanks for the info Val, I will check Office Max, that is good to know.
Terri, good ideas I will also check online about a living will.
Hopefully other Ratbone people see this and can explain more about the contract.

Monica, I don't think the Ratbones contract is necessarily binding when the adopter passes away. In my humble opinion the contract is written this way so that people don't get rid of their dogs to just anybody and understand they can return the dog should they ever feel the need to. I also adopted from Ratbones, and I would honestly hope that Ratbones and a court of law would respect my wishes to have my girls go live with someone of my choosing if I included it in my will. The fact that you are thinking of your dog and doing this says a lot about you and your concern about Daxter. Who better than you could decide where he should be? I don't think in that situation Ratbones, or anyone else, has the right to decide for you, if you've put it in a will. Know what I'm saying?

Terry, that's makes sense to me.
I think you are right because technically when the person pass away they are no longer available to abide the contract and at that point it automatically ended the contract.

As an adopter - I am putting in my will that my dogs be returned to Ratbone, because I don't want anyone else taking care of them, and I sure as heck don't want them brought to a shelter.

How many times do we hear of dogs being dumped at shelters when the owners die?  What if whomever you leave your dogs to decides they don't want them and they dump them in a shelter?  I think the safest thing to do is to ask the dog to be returned to Ratbone, and if anybody from the family is interested in adopting the dog, to apply for them.  Just my humble opinion, of course.

I am hoping I don't die before they do, either...........

I am hoping that I don't die before they do either Sue....
That's actually what happened to Daxter, he got dump at the shelter when his owner pass away and I don't want him to end up in the shelter again. He been thru a lot in his past.
Thanks for the thoughts, now I have a lot to think about what is best for him. I don't mind he go back to Ratbone, I just want him to be safe and have a loving home just in case.

The clause in our contract is mainly to prevent our dogs being given away or dumped if the adopter decides they don't want them any more. In the case of an adopter who dies - if you want to specify in your will who you want Daxter to live with in the event of your death - Ratbone will honor that. We just ask that you have the person you assign ownership to contact us to let us know that Daxter has a new address.
